Acceptance
By using tryeverwell.com or our telehealth platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.
Eligibility
You must be:
- At least 18 years of age
- A legal U.S. resident in a state where Everwell currently operates
- Capable of providing complete and accurate health information
- Not subject to any legal restriction preventing you from receiving telehealth services
Where Everwell Is Available
Everwell’s services are available in all U.S. states except Mississippi and Louisiana.
Everwell is available in the following jurisdictions: Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, District of Columbia, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.
Eligibility is confirmed during intake. Patients located in states we do not currently serve are informed they are not eligible before any order is placed.
Try EverWell Is Not a Medical Provider
Try EverWell is a technology and coordination platform. It does not practice medicine, employ healthcare providers, or direct clinical decisions.
All clinical services are provided by independent, licensed healthcare providers who are not employees or agents of Try EverWell.
Our Medical Providers
Clinical services offered through Try EverWell are provided by independent, licensed U.S. physicians affiliated with MDI Medical Group, PC, an independent physician network, under the medical direction of Marc Serota, MD. All treating physicians are licensed in the state in which the patient is located and in which care is delivered.
Before your visit, you are shown your assigned physician’s name, photograph, biography, and active state license information, and you may select a different physician if you prefer. For patients in states that require public disclosure of provider information, including Massachusetts, Rhode Island, and Vermont, this section serves as that public disclosure.
Telehealth Services & Limitations
By using Try EverWell, you acknowledge:
- Telehealth cannot replace physical examination
- Prescriptions are issued only when a licensed clinician independently determines they are appropriate
- A prescription is never guaranteed
- Telehealth is not appropriate for emergencies
- Your clinician may refer you to in-person care
Prescription Policy
Prescriptions are issued at the sole discretion of independent, licensed clinicians. Try EverWell does not direct or influence prescribing decisions.
Controlled substances are never prescribed. Compounded medications are not FDA-approved. Prescriptions are for personal use only and may not be transferred or resold.
Accurate Health Information
You agree to provide complete, accurate, truthful information in your health intake and all care communications. Providing false or misleading information may result in harm, account termination, and potential legal liability.
Payment
Try EverWell is self-pay only. No insurance, Medicare, Medicaid, or government health programs accepted. By submitting payment, you authorize Try EverWell to charge applicable fees.
Recurring plans renew automatically until cancelled per our Refund Policy.
Prohibited Use
You may not:
- Obtain medications for others’ use
- Provide false health information
- Attempt to obtain controlled substances
- Share account credentials
- Resell or redistribute medications obtained through the platform
Limitation of Liability
To the maximum extent permitted by law, Try EverWell shall not be liable for:
- Clinical decisions by independent clinicians
- Adverse outcomes related to treatment
- Technical interruptions
- Indirect, incidental, or consequential damages from platform use
Nothing in these Terms limits liability for gross negligence, willful misconduct, or violations of applicable law.
Governing Law
These Terms are governed by California law. Disputes are subject to the exclusive jurisdiction of courts in Los Angeles County, California.
Changes To These Terms Of Service
We may update these Terms. Material changes will be posted with an updated effective date. Continued use constitutes acceptance.
